What is fly-tipping?
Fly-tipping is the illegal deposit of waste on land not licensed to receive it. A producer whose waste is fly-tipped can be liable if they failed to take reasonable steps under the duty of care.

</figure>Liability does not stop with the person who tipped it. Waste is routinely traced back through documentation, and a producer who handed it to an unregistered carrier for cash has not met the duty of care regardless of what happened next.
The practical defence is the evidence of reasonable steps: the carrier's registration checked on the register, a properly completed transfer note, and a description accurate enough that the destination made sense.
For landowners, waste tipped on their land generally becomes their problem to clear, which is why access control and prompt reporting matter commercially as well as legally.
What goes wrong in practice
- Cash collections arranged without any check of who is taking the waste.
- No transfer note retained, leaving nothing to show the waste was passed on lawfully.
- A vague waste description that makes the movement untraceable in either direction.
